I have been getting lots of inquiries regarding Bill 11-03, the fortune teller legislation. I want to explain what is happening with regard to Mr. Guthries’ Bill 11-03
In June of 2010 the Maryland Court of appeals struck down a Montgomery County Law to ban Fortune Telling etc. from the county. The Montgomery County law was challenged on a Freedom of Speech issue and the plaintiffs won. The current law in Harford County mimics the Montgomery County law and if challenged would obviously be struck down also. Because of the Maryland Court of Appeals decision in 2010 a county cannot outlaw Fortune Telling, Tarot Card reading and the like. A county can control where they do business and thus Mr. Guthrie’s bill 11-03 seeks to amend our current law which currently permits these establishments, but would allow Harford County to dictate or control the location of such establishments. In Harford County, Bill 11-03 will allow them to operate in B2 and B3 business districts only. There is virtually no wiggle room to outlaw fortune tellers in general.
