Submits specific details on non-citizens that cast votes in Frederick County, Maryland to the State Board of Elections for follow-up, prosecution
Election Integrity Maryland announces today that it is continuing to fight non-citizen voting and asks for follow-up and action by local authorities. Non-citizen voting poses a critical threat to free and fair elections within the state and nation at large.
In October 2014, Election Integrity Maryland officials submitted specific names and addresses to the Maryland Board of Elections as a follow-up action for identified non-citizen individuals who cast votes in recent elections in Frederick County and who also remain on the voter rolls, despite their non-citizenship status. Examination of a brief segment of the larger data, collected by the Frederick County Jury Commissioner, revealed continually-appalling statistics around this issue, including:
– 10 identified non-citizens who cast votes in General and Primary elections in 2012;
– 6 non-citizen individuals whose address on file appears to be incorrect, falsified, and/or potentially fraudulent; and
– 6 additional non-citizens whose names remain on the current voter rolls despite their ineligibility. The lack of attention to remove them could result in these non-citizens being summoned to serve on juries and/or permitted to cast votes in future elections, including the upcoming 2014 Mid-Term Election, if urgent attention is not paid and action taken.
Recent data submitted by another leading election integrity organization, Virginia Voters Alliance, also detailed 278 non-citizens who actively cast votes in recent elections in Virginia. This recent case, following the previous announcement of the confirmed 164 double voters out of 43,893 potential duplicate voters that have also participated in election processes, have continued to go unnoticed and largely ignored by Attorney General Eric Holder and the Fairfax County Prosecutor’s office.
This latest news, particularly the startling numbers just out of Frederick County, presents clear evidence of voter fraud and proven cases of non-citizen voting activity, which holds significant potential to threaten outcomes and the integrity of our overall electoral process. Further, the refusal of action taken by appropriate authorities sharpens larger concern, namely that voting eligibility is limited to U.S. citizens only is the current law in all 50 states.
The latest developments in the disturbing issue of non-citizen voting activity also put the lack of investigation and prosecution at the federal level into sharp perspective. Non-citizen voting activities are in direct violation of the “Federal Prosecution of Election Offenses” handbook written by the Department of Justice’s Public Integrity Section. In fact, “falsely claiming to be a citizen on a voter registration form,” the exact offense noted above, actually violates three federal statues, 42 U.S.C. §1973gg-10(2), 18 U.S.C. §1015(f), and 18 U.S.C. §911. Violations of each of these are felony infractions, punishable by imprisonment of up to three or five years, depending on the specific statute. In addition, “actual voting” by a non-citizen, known to be the case for at least 10 individuals recently reported in Frederick County and 117 individuals in the above Virginia example, violates 18 U.S.C. §611 and is a strict liability offense. Otherwise stated, it “does not require proof that the offender was aware that citizenship is a prerequisite to voting.” Violations are misdemeanors punishable by up to one year in prison.
Most alarming of all in this recent example is the complete lack of interest by the Justice Department in investigating and prosecuting these nearly 300 cases of potential felony violations of federal law, which should be the primary focus and mission of the Department’s activities.

When you put the same kinds of restrictions on Absentee ballots, mail in ballots and use the same exact procedures on everyone then we can talk about transparency. The only transparency wanted in one in which minorities have to go through extra hoops and barriers to vote. When you start restricting soldiers voting in other countries and restricting absentee balloting in the same manner, then we can talk about making the playing field equal. Statewide, the republican and tea party don’t stand a chance to win and nationally the seeds sown by the right wing nuts show that you an carry Texas an a few southern states, rural areas and not much else. Pretty much minorities, women, disabled, elderly, environmentalists, gays and any other interest group that doesn’t include military is excluded from your party. I am really more concerned about the deceit and barriers being erected around the universal right to vote. Aside from the occasional event of votes being improperly casted and counted, the system has proven to be more accurate than not.

As you also know MD and VA share a border and a name is not purged from the voter role instantly. Additionally the methodology of the report they used the odd year governors election in Virginia as their data point. Is it possible 164 people voted in state A in one year, moved and voted in state B another year but forgot to notify state A’s board of elections they moved?

I agree with the Professor, those 164 votes aren’t alarming. I don’t think Maryland has a voter fraud issue. Other states have shown a significantly higher discrepancy with the voter totals and how many is registered in their state’s districts. That is a problem, but that is not Maryland……

Baskin rob– I don’t remember any recent time or past where I was asked for my driver’s license! My doctor knows who I am and if I go see another doctor all they need is my insurance card. Fact– If you don’t drive, there isn’t a law that says you have to have a photo ID with you at any time and you aren’t breaking any law.
If a valid photo ID was required to vote in this country there would never be another Democrat elected to any office After all, it’s only those mean Republicans that want to curtail the rights of the poor or minorities.
You need some ID to get all the government freebies. So, the meek and downtrodden already have ID. Voting is a basic right that doesn’t need to be infringed upon, proof of citizenship is required when you register to vote.

The issue of ID would be fine if we had followed through with the REAL ID act and made getting an ID free, easy and convienet. The problems are when you make someone drive 300 miles to get a free one, take a gun liscence but not a state issued college ID, etc.

MD Driver’s License, MD ID or if lacking those, the last 4 digits of your SS#–from the Board of Elections Website. As long as you can prove you are who you say you are, then you are in the clear. The Board of Elections are to determine if duplicate records exist, verify address/district and purge registration records on an ongoing basis. One can register at 16, but can’t vote until next election to 18 yrs old.
How is a Driver’s License proof of citizenship? I just looked at mine and nowhere on it does it say if you are a citizen or not. I know Maryland issues Driver’s Licenses to people with Green Cards and they aren’t citizens……..

Good job educating the masses at the Dagger. Notice when the conversation turns to facts that the usual tea suspects and village idiots don’t have anything to say? The professor was talking about documents needed to register to vote and other people pointed out items needed to obtain a Federally ID compliant ID. Maryland has another ID for non-documented residents, not citizens which clearly is coded to not be used for registering to vote. Only a federally ID compliant ID can be used for voting purposes in states that require an ID to vote. Part of the problem is that the state ID/driver’s ID system wasn’t created to determine citizenship and some local jurisdictions allow non-citizens to vote on local matters. As an aside please know while the military allows non-citizens to serve, they aren’t allowed to vote? Which is a bit of a moronic statement on its own. Congress and Executive hire only citizens but Judiciary allows non-citizens to hold employment within their jurisdictional powers. What we got is a mess of state laws differing and a federal law trying to bring uniformity which doesn’t create the best system to make things efficient and coordinated.
Heard there are problems with early voting, it seems people voting Republican and votes tallied as Democratic and that’s not people voting without a right, it is the machine tabulating incorrectly. Republicans already calling for an investigation. Machines were tested and results could not be duplicated. Perhaps some of the older republican voters just don’t know how to read or push the right keys??? It seems like it. We should move to purple paint on the fingers just like in Afghanistan.
The same thing was happening two years ago. I had to clear and restart my machine and it still got it wrong. I have neither long nails nor fat fingers. The problem is in the machines. This year I will use my cell phone to record the results versus the input. I’m sure the election judges will freak out but I’ll try it anyway.
