Del. McDonough Calls Health Care Ruling a Victory: “The Law of the Land Today is that Obamacare is Unconstitutional”

“While I am concerned about rising health care costs, on both a national and a state level, any solution reached must be constitutional.”……Delegate Pat McDonough

Delegate Pat McDonough (R-Dist. 7) welcomed the news that 26 states scored a substantial victory in federal court concerning the unconstitutional Health Care Reform Law, known as Obamacare. The states had urged the court to strike down the “individual mandate” provisions of the act passed by Congress requiring that Americans buy health insurance or face a penalty. The court ruled that the entire act is unconstitutional because the individual mandate portion cannot be separated out from the act.

Del. McDonough applauds the ruling from U.S. District Judge Roger Vinson which recognized that Congress had reached well beyond its constitutional authority. “The democrat Congress reached well beyond its authority into the lives and freedom of Americans,” McDonough said.

As the Health Care Reform Law has been ruled unconstitutional by two federal district courts, McDonough is urging Gov. O’Malley and the General Assembly to await clarification before moving forward with costly state provisions of Obamacare.

“I am requesting a ruling from the Maryland Attorney General concerning implementation of any aspect of Obamacare in this year’s budget as I fear the Governor may be violating his oath of office if he allocates tax dollars for an unconstitutional program”, stated McDonough.

According to McDonough, all Maryland legislators, including the Governor, have taken an oath to defend both our state and our national constitution, and until this issue is decided by the Supreme Court we must follow the law.

“The law of the land today is that Obamacare is unconstitutional”, said McDonough.

    This guy equates the decision of a Federal District Court Judge to “the law”??????????? What a moron! Higher Courts overturn District Court decisions all the time. And we elected this boob to represent us in Annapolis??????

    This article shows how little he knows abut the law or else he is trying to give false information to support his opinion. There are a number of laws that apply to everyone like car insurance, fishing license, and many regulations.

    He does not mention the other judges that found the law constitutional.

    I for one are tired of paying extra for my insurance for free loader to go to the hospital emergency room and get free treatment.

    What I keep wondering is why to we keep electing morons?!

    This is why I changed my party.

      So you’d rather pay for this? Not to mention the crushing debt our nation will incur. I would like to see some form of health care reform but not on the level of this monstrosity. A couple things in the act are agreeable but Congress went way overboard in their effort to emulate European style health care. Repeal or reject and start over. And this time Read The Bill.

    As a senior I am grateful for the Patient Protection and Affordable Care Act (Public Law 111-148) and the Health Care and Education Reconciliation Act (Public Law 111-152) that:
    -helps to close the prescription drug coverage gap for Maryland’s 741,000 seniors by providing seniors with a 50% discount on all brand name drugs while they are in the ‘donut hole’ provides tax credits for up to 56,000 Maryland small businesses to help them purchase health insurance for their employees
    -prohibits insurance companies from denying coverage to Maryland’s 1.4 million children, even if they have a pre-existing condition
    -allows 535,815 young adults ages 26 and younger to stay on their parents’ insurance while they get on their feet
    -reduces the federal deficit by $143 billion and Maryland’s health care costs by $1 billion over the next 10 years
    -and extends the solvency of Medicare by nearly a decade
    Thank you Democrats!

      Reduces federal deficit by $143 billion……bwahaaaaaaaa…sorry I laughed so hard I caused myself a hernia. Guess I’ll run down to the doctor, put my name on a waiting list, wait 18 months to 2 years for a government official to approve the surgery and get it fixed. Yeah thanks Democrats. Where can I get my waiver. Ooops, Im not in a union. Guess I’m out of luck.

      Actually, 1,173 people voted for Myers, who finished 3rd in a 5-person race, and lost out on advancing to the General Election by about 150 votes:

    Delegate McDonough,

    I hope you and your colleagues support HB 241/SB 240 Criminal Law
    –Restrictions Against Use and Possession of Firearms, that would enhance penalties for those in possession of firearms who have previous firearm convictions. Its about time that Maryland law really punished those criminals from committing the same or similar types of crimes with firearms. Please support this bill and encourage your constituents to see the light. Even the NRA won’t oppose this one.
